The Delhi High Court Monday quashed a criminal complaint against a man accusing him of kidnapping the daughter of a city policeman, as the alleged abductor had married the girl three years ago.
Justice A.K. Sikri ordered cancellation of the first information report (FIR) registered against Rahmete Azam from Bihar, with whom Delhi policeman Zulfiquar Ahmed's daughter Rukshana had reportedly eloped. The two had subsequently married in Patna before a local Muslim priest.
'I am of the view that no useful purpose would be served in continuing with the proceedings. Therefore, the proceedings arising out of the FIR in question are quashed,' the court said while passing the order on the petition of Rukshana praying for cancellation of the FIR.
Justice Sikri dismissed the petition saying that 'After the marriage, they have been living together as husband and wife and from the wedlock they have also been blessed with a male child.'
Rukshana's father Zulfiquar Ahmed of Mongalpuri had lodged a complaint with the police on Dec 28, 2004 that his 16 year-old daughter had been kidnapped by his neighbour Rahmete while she going to attend a tuition class.
But the couple later told the court that they had fled together first to Vadodara in Gujarat from New Delhi and from there to Bihar.
They also told the court that their marriage was solemnised by Quazi Khanka Umadiya Mangal Talab in Patna on May 6, 2005.
Rukshana had produced her school leaving certificate which mentioned that she was 16 years and six months at the time of marriage.
She had also submitted before the court that she had fled with Rahmete on her own will and she had given consent to the marriage.
The court said since both the girl and boy had attained majority at the time of the marriage they could not be prosecuted for the offence lodged in the criminal complaint.
